THIS IS A LIVING DOCUMENT

This Terms of Service will be updated over time. By creating an account, you accept not only the current version but also future versions as described in Section 11. You will be notified of material changes by email at least 30 days before they take effect.

Please read these Terms of Service ("Terms") carefully before registering for or using www.seiclass.com (the "Platform"), operated by Success Educational Institute LLC ("SEI," "we," "us," or "our"). By creating an account, purchasing a course, or accessing any content, you agree to be legally bound by these Terms — including the living-document framework in Section 11, which means you also agree to future updates as described therein.

1. ELIGIBILITY

To register for and use our services:

  • You must be at least 18 years of age.
  • You must be a human individual — automated registrations are not permitted.
  • You must provide accurate, complete, and current registration information.
  • You must have legal capacity to enter a binding contract.
  • You must have authority to make purchases using the payment method you provide.

NOTICE — Eligibility Requirements May Change

SEI may update eligibility requirements in future versions of these Terms (for example, if we add programs with different prerequisites or expand to new jurisdictions). Changes will be communicated as described in Section 11.

2. ACCOUNT REGISTRATION AND SECURITY

2.1 Accurate Information

You agree to provide accurate, complete, and current information during registration and to keep it updated. False or misleading information may result in immediate account termination.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials (username and password). You agree to:

  • Use a strong, unique password.
  • Not share your login credentials with any other person.
  • Not allow third parties to access your account or course content.
  • Notify us immediately at SEIExams@gmail.com if you suspect unauthorized access.

We are not liable for any loss or damage arising from your failure to safeguard your account credentials.

2.3 One Account Per Person

Each registration is for a single individual. Multiple accounts for the same person, or shared accounts, are a violation of these Terms and may result in termination without refund.

3. COURSE ACCESS AND LICENSE

3.1 License Grant

Upon purchasing a course, SEI grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use purchased course content solely for your personal FE or PE Civil exam preparation during the access period.

3.2 Access Period

Each purchase grants access for the duration listed on the course page at the time of purchase. Access ends automatically when the period expires.

NOTICE — Access Periods May Change for Future Purchases

Access period lengths are subject to change for future course purchases. Changes do not affect access periods already purchased. The access period applicable to your purchase is the period displayed at the time of your transaction.

3.3 Prohibited Conduct

You agree that you will NOT copy, share, screen-record, redistribute, or commercially use any Course Materials; share login credentials or signed video links; allow others to access your account; use automated tools to scrape the Platform; or circumvent any security measures. Full detail is provided in the separate Copyright & Content Use Agreement, which is incorporated into these Terms by reference.

4. INTELLECTUAL PROPERTY

All Course Materials are the exclusive intellectual property of SEI and are protected by U.S. copyright law. Your purchase grants only the limited personal license described in Section 3.1. All rights not expressly granted are reserved by SEI. Full terms are set out in SEI's Copyright & Content Use Agreement, which you must accept before accessing any course content.

SEI is not affiliated with, endorsed by, or officially connected to NCEES. The FE and PE exam names are trademarks of NCEES.

5. PAYMENTS AND REFUNDS

5.1 Pricing

Course prices and access periods are listed on each course page at the time of purchase.

Course prices and access periods are subject to change at any time for future purchases. Changes do not affect purchases already completed. SEI is not obligated to offer the same pricing to existing customers as to new customers.

5.2 Payment Processing

All payments are processed by Stripe. SEI does not store full payment card details.

NOTICE — Payment Processors May Change

SEI may change its payment processing provider at any time. Any new provider will be disclosed in an updated version of this Terms and the Privacy Policy. The core commitment — that SEI does not store your card details — will remain.

5.3 Refund Policy

No refunds are issued once a course has been accessed. Refund eligibility is strictly limited to verified billing errors and is subject to the following conditions:

  • Eligibility Window: A refund request for a billing error must be submitted before whichever of the following occurs first: (a) 7 days have elapsed since the date of purchase, or (b) more than 30% of the purchased course content has been accessed. Once either threshold is reached, no refund will be issued under any circumstances.
  • 5% Service Fee: If a refund is approved, a non-refundable 5% service fee will be deducted from the refunded amount to cover non-recoverable payment processing and administrative costs. The remaining 95% will be returned to the original payment method.
  • Example: If you paid $200 and a refund is approved, you will receive $190. The $10 service fee (5%) is non-refundable.
  • How to Request: Email SEIExams@gmail.com with your full name, registered email address, order details, and a description of the billing error. Requests submitted after either threshold above has been reached will not be considered.

SEI reserves the right to verify course access percentage before processing any refund request. Access data logged by the platform is considered the authoritative record.

Approval is at SEI's sole discretion. Submitting a refund request does not guarantee approval.

Chargebacks or payment disputes initiated without first contacting SEI may result in immediate account suspension pending investigation.

Accounts terminated for violation of these Terms — including credential sharing or content redistribution — are not eligible for any refund.

NOTICE — Refund Policy May Change

SEI's refund policy may be updated in future versions of these Terms. Changes to the refund policy apply only to purchases made after the effective date of the update. The refund policy in effect at the time of your purchase governs your transaction.

6. DISCLAIMERS

6.1 No Guarantee of Exam Results

SEI MAKES NO GUARANTEE, EXPRESS OR IMPLIED, THAT USE OF THE PLATFORM WILL RESULT IN PASSING THE FE OR PE CIVIL EXAM. Exam outcomes depend on individual effort, preparation, and performance.

6.2 Content Accuracy

We make reasonable efforts to keep content current with NCEES exam specifications. SEI is not liable for inaccuracies arising from NCEES updates made after our last content revision.

NOTICE — NCEES Exam Formats Change

NCEES periodically updates FE and PE exam specifications, reference materials, and formats. SEI will make commercially reasonable efforts to update course content in response to NCEES changes, but SEI cannot guarantee that all content will reflect the most current NCEES specification at all times.

6.3 Platform Availability

The Platform is provided on an 'as-is' basis. We do not guarantee uninterrupted or error-free operation. SEI is not liable for service interruptions due to maintenance, technical issues, or third-party outages.

NOTICE — Platform Features May Change

SEI may add, modify, or discontinue platform features, tools, or programs at any time. We will provide reasonable notice of discontinuation of paid features. The addition of new features may be governed by supplemental terms, which will be disclosed at the time of introduction.

7. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SEI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST EXAM FEES, LOST INCOME, OR LOST PROFESSIONAL OPPORTUNITIES — ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO SEI IN THE 12 MONTHS PRECEDING THE CLAIM.

8. PRIVACY AND DATA COLLECTION

Your use of the Platform is governed by our Privacy Policy at www.seiclass.com/privacy, which is incorporated into these Terms by reference. Both documents are living documents that will be updated over time. See Section 11 below and Section 13 of the Privacy Policy for how changes are governed.

9. ACCOUNT TERMINATION

9.1 Termination by You

You may close your account at any time via your portal settings or by contacting SEIExams@gmail.com. See Section 11.5 for your right to close your account before material changes to these Terms take effect.

9.2 Termination by SEI

SEI may suspend or terminate your account without notice for violation of these Terms, credential sharing, fraudulent activity, or distributing Course Materials. Terminated accounts are not entitled to a refund.

10. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Florida. Any dispute arising from or relating to these Terms or your use of our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in Miami-Dade County, Florida, in accordance with the rules of the American Arbitration Association. You and SEI agree to individual-only arbitration — no class actions.

Either party may seek injunctive relief in court to prevent unauthorized use or distribution of proprietary Course Materials.

NOTICE — Dispute Resolution Terms May Change

SEI may update the dispute resolution provisions of these Terms, including the arbitration clause, in future versions. Updated dispute resolution terms will apply only to disputes arising after the effective date of the updated Terms. Disputes arising before that date will be governed by the version in effect at the time the dispute arose.

11. CHANGES TO THIS TERMS OF SERVICE — LIVING DOCUMENT

IMPORTANT: This is a Living Document.

This Terms of Service is a living document. It will be updated over time as our platform grows, applicable laws change, or our data and business practices evolve. By registering for an account, you acknowledge and accept that this document will change and that your continued use of the Platform constitutes acceptance of the then-current version.

11.1 Your Agreement to Future Updates

When you create an account on the SEI platform, you are agreeing not only to the current version of this Terms of Service but also to the process by which it will be updated. Specifically, you acknowledge and agree that:

  • SEI may update, modify, or replace any provision of this Terms at any time, for any reason, including but not limited to changes in applicable law, changes to our data practices, changes in the services we offer, or changes in our business operations.
  • Updates will be effective upon posting to the Platform, unless a later effective date is specified.
  • Your continued use of the Platform after an update is posted constitutes your binding acceptance of the revised document, even if you have not read it.
  • If you do not agree to an updated version, your sole remedy is to discontinue use of the Platform and close your account as described in the account termination section above.

11.2 How We Will Notify You of Changes

We distinguish between two types of changes:

  • Non-Material Changes — minor updates such as correcting typographical errors, clarifying existing language, updating contact information, or adding more detail to an already-disclosed practice. These may be made at any time without direct notification.
  • Material Changes — updates that meaningfully alter your rights, our data practices, or the core terms of our relationship. For material changes, we will:
    • Post a prominent notice on the Platform and/or at the top of this document marked with a new effective date.
    • Send an email notification to your registered email address at least 30 days before the change takes effect, where practicable.
    • Where required by applicable law (including the Florida Digital Bill of Rights), obtain your affirmative consent before applying certain changes retroactively to your existing data.

Examples of material changes include, but are not limited to: a change in data retention periods, a new category of data we collect, adding a new third-party service provider, or beginning to sell or share data in a new way.

11.3 Data Retention — Prospective Application of Changes

IMPORTANT NOTICE REGARDING DATA RETENTION CHANGES

SEI may update the data retention periods specified in this Policy over time. For example, a retention period that is currently stated as 5 years may be extended to 10 years or longer in a future version of this Policy.

By registering for an account today, you acknowledge and accept that:

  • Retention period changes will apply to data collected after the effective date of the updated Policy.
  • For data already collected, SEI will provide 30 days' advance email notice before applying any extended retention period, and you may request deletion of your existing data before the new period takes effect.
  • Retention extensions required by law or for tax, accounting, or legal compliance purposes may apply without your individual consent.

Current retention periods are stated in Section 6 of this Policy. Those periods represent SEI's current practices and are subject to change as described above. The most current version of this Policy, always available at www.seiclass.com/privacy, governs the retention of your data at any given time.

11.4 Changes That Require Fresh Consent

Notwithstanding the general living-document framework above, SEI will always obtain your fresh, affirmative opt-in consent before:

  • Selling or sharing your personal data with third parties for their own marketing purposes (we do not currently do this).
  • Collecting new categories of sensitive personal information as defined under the Florida Digital Bill of Rights (e.g., health data, biometric data, precise geolocation).
  • Materially changing the purpose for which your data is used in a way that is incompatible with the purpose for which it was originally collected.
  • Extending data retention in a way that applies retroactively to data already collected, beyond what is permitted by law.

For these categories of change, we will present a clear, affirmative consent request before the change applies to your data. If you decline, your existing data will be handled under the prior policy terms.

11.5 Your Right to Close Your Account Before Changes Take Effect

If you receive a notice of a material change and you do not wish to be bound by the updated terms, you may close your account before the stated effective date of the change. To close your account:

  • Use the self-service account deletion option in your portal settings, or
  • Contact us at SEIExams@gmail.com with your request.

Account closure before a change takes effect means the prior version of this document will govern the handling and deletion of your existing data. Closing your account does not entitle you to a refund outside the refund window stated in the Terms of Service.

11.6 Version History

The version of this Terms of Service currently in effect is always the version posted at www.seiclass.com/terms. The effective date at the top of this document indicates when the current version took effect.

Summary of What You're Agreeing To Regarding Future Changes:

  • This document will change over time — that is expected and accepted.
  • You will receive 30 days' notice of material changes by email.
  • Continued use after changes = acceptance of the new version.
  • Data retention periods may increase in future updates; notice will be given.
  • Changes that require selling your data or collecting sensitive data require your fresh consent.
  • If you disagree, you can close your account before the change takes effect.

12. GENERAL PROVISIONS

12.1 Entire Agreement

These Terms, together with the Privacy Policy and the Copyright & Content Use Agreement, constitute the entire agreement between you and SEI regarding your use of the Platform.

12.2 Severability

If any provision is found invalid or unenforceable, the remaining provisions continue in full force.

12.3 Waiver

Our failure to enforce any provision is not a waiver of our right to enforce it in the future.

12.4 Assignment

You may not assign your rights under these Terms without our written consent. SEI may assign these Terms without restriction.

12.5 Force Majeure

SEI is not liable for failure to perform due to circumstances beyond our reasonable control, including internet outages, third-party service failures, or government actions.
